TERMS & CONDITIONS
The following terms and conditions apply to any order which is confirmed with payment, or confirmed in writing if an account is held with us.
Please read the following terms and conditions before issuing a complaint via the form available here.
- PLACING YOUR ORDER
1.1 Once an order has been placed we will send you an invoice to confirm we have received payment. You are required to make certain all details are correct as per your requirements within 24 hours, or 1 working day, of receiving a spec or proof or 3rd Rail may not be able to guarantee agreed lead times. We will customise products based on the information provided on the approved spec sheet and cannot be held responsible for any discrepancies between the spec sheet and your requirements after this document has been approved by the customer.
1.2 If something isn’t included or is incorrect on your invoice you must flag it up in writing and we’ll resend a corrected document. Any work already in progress will not be refunded, this includes artwork films, screens, ordered garments etc.
1.3 Any changes to garments or products (including quantities, type, colour and sizing) ordered after payment or confirmation of order (prior to and not including the approval of spec sheet) may not be possible or will incur additional restocking fees.
1.4 The final quantity of garments printed is subject to a +/- 5% tolerance. This is due to unavoidable issues that can occur during printing which we cannot foresee. If you require an exact amount of garments please take this into account when choosing your quantities to order.
1.5 If you are supplying garments you are responsible for communicating any special technical requirements for these (e.g: whether the garment will discharge, fabric content, measurements). Failure to do this before the order is confirmed could result in delays. Although we are happy to print onto supplied garments please note that you do so at your own risk and we will not be held responsible or compensate for anything that goes wrong during production. 3rd Rail accepts no responsibility to pay for any fees or charges that arise as a result of this. We recommend that you send an extra 5% of the quantity as spares for product testing.
1.6 We recommend all garments are washed before worn.
1.7 Products are sourced from third-party manufacturers and may change over time. For repeat orders, we cannot guarantee exact consistency with previous runs in areas such as material, colour, weight, sizing, or finish.
Repeat orders are supplied to the manufacturer’s current specification unless otherwise agreed in writing prior to production. Variations arising from supplier changes do not constitute a defect.
1.8 Customer Supplied Goods & Storage
Where customer supplied garments, materials, packaging, or other goods are delivered to 3rd Rail, the customer remains responsible for those goods unless otherwise agreed in writing.
3rd Rail reserves the right to charge reasonable storage fees for goods left beyond an agreed period.
Goods left uncollected for an unreasonable period may be disposed of or recycled at 3rd Rail’s discretion without liability.
1.9 Right to Refuse Service
3rd Rail reserves the right to refuse, pause, cancel, or suspend any quotation, order, account, or service at its discretion, including but not limited to situations involving abusive behaviour, suspected unlawful activity, non-payment, intellectual property concerns, unreasonable conduct, or operational limitations.
- ARTWORK
2.1 All artwork must be supplied at high resolution (at least 300dpi), actual print size, and in CMYK mode. It is essential that the file you supply is as high quality as possible as this will affect the print quality. We accept PSDs, PDFs, Vectors and JPEGs.
2.2 If you require an exact ink colour, please provide a Pantone reference, otherwise we will use the closest match as per our computers. Every effort will be made to reproduce ink colours for reprints but please send us a sample if you require an exact match.
2.3 The customer is responsible for supplying artwork to us for which they have the relevant permissions or licenses to use for print. We accept no responsibility for any copyright infringements caused by using artwork supplied to us.
2.4 We are always happy to offer guidance for the best size and position for your print on the garment, however if you have specific requirements it is your responsibility to communicate this to us and have it confirmed in writing.
2.5 Ownership of Production Files & Setup Work
Unless otherwise agreed in writing, all artwork preparation, separations, digitising, setup files, mockups, screen setups, production files, and related working materials created by 3rd Rail remain the physical and intellectual property of 3rd Rail.
Payment for setup or preparation charges does not constitute transfer of ownership of production files or working materials.
- PAYMENT
3.1 Full payment is due before we start working on your order unless agreed otherwise by us in writing.
3.2 If a working relationship is established then a credit account can be set up with us at our discretion. Payments on account are due 30 days from the date of invoice.
3.3 If in the event that a credit is applied to your account, the credit balance MUST be used within 12 months of the credit being applied. If the credit is not used within this time period, 3rd Rail. reserves the right to void the initial credit balance.
3.4 Late Payments & Debt Recovery
3.4.1 Payment Terms: All invoices must be settled within the agreed payment period stated on the invoice. Failure to do so may result in additional charges.
3.4.2 Late Payment Charges: If payment is not received by the due date, we reserve the right to:
Charge interest at a rate of 8% per annum above the Bank of England base rate (or the statutory rate under the Late Payment of Commercial Debts (Interest) Act 1998).
Apply an administrative late payment fee of £250.
3.4.3 Debt Collection & Recovery Costs: If an invoice remains unpaid beyond the agreed period, we may:
Engage a third-party debt collection agency or take legal action to recover the outstanding amount.
Charge the customer for all reasonable costs incurred in the recovery process, including but not to legal fees, debt collection fees, and administrative expenses.
3.4.4 Compensation for Late Payment: In accordance with the Late Payment of Commercial Debts Regulations, we may charge statutory compensation fees of:
£40 for debts up to £999.99
£70 for debts between £1,000 and £9,999.99
£100 for debts over £10,000
3.4.5 Suspension of Services: We reserve the right to suspend or withhold further work or deliveries until overdue payments are settled in full.
3.5 Quote Validity
Unless otherwise stated in writing, all quotations and pricing provided by 3rd Rail are valid for 14 days from the date issued.
3rd Rail reserves the right to revise pricing after this period, including where supplier costs, shipping costs, material costs, exchange rates, or production costs have changed.
- DELAYS
4.1 Our normal turnaround is 10 to 15 working days but this may fluctuate. We will make every effort to communicate the current turnaround at the time of ordering.
4.2 If your job has a deadline this must be discussed with us at the time of ordering otherwise we cannot guarantee that we can meet the date. We will always endeavour to meet customer deadline but can accept no responsibility for costs incurred by missed photoshoots or loss of sales for not meeting dispatch or delivery deadlines.
4.3 Certain print types such as all-overs, garment customisations or post-print services (re-labelling, folding and bagging) may extend the lead time. e.g: All-overs are printed in runs of maximum 50 prints per run, as after this time the quality of the print starts to degrade. Additional runs after the first 50 all-over prints will also require an additional half price setup fee.
4.5 We order all garments in per individual order and are not responsible for stock levels of garments from our suppliers. If we discover an ordered item has gone out of stock we will notify you as soon as possible to arrange a suitable replacement. We are not responsible for delays to orders caused by garment stock levels.
4.6 Orders required sooner than our usual turnaround may incur a rush fee.
4.7 All deliveries are handled by a third party courier who are in control of delivering orders as per the services that we book with them. We can not be held accountable for losses or delays caused by the courier but we will attempt to make the relevant claims on our side if this should occur and rectify the situation as best we can.
- RETURNS AND CANCELLATIONS
5.1 If you discover a fault with part or all of your order you have 14 days to return the goods to us. After this time the goods will be considered to have been accepted, and a refund or replacement will not be offered.
5.2 You will be required to arrange and pay for delivery costs for returning goods, however at our discretion we may reimburse you for carriage costs if we find the fault to be on our side.
5.3 3rd Rail have the option to either refund or replace all, or part of, your order if a fault has been made.
5.4 It is your responsibility to take proper care of any goods that are to be returned whilst in your possession and to ensure that they are not worn, altered or damaged. We reserve the right to refuse to accept returns of any goods that do not comply with this.
5.5 Cancellation Requests
Requests to cancel, postpone, amend, or reduce an order must be submitted in writing.
Due to the custom and made-to-order nature of our services, cancellation requests are not automatically accepted and may not be possible once work, sourcing, procurement, scheduling, preparation, or production commitments have commenced.
3rd Rail reserves the right to recover all costs, charges, labour, materials, commitments, and losses incurred up to the point of cancellation or amendment.
Any refund, partial refund, or credit remains entirely at the discretion of 3rd Rail.
5.6 If we have begun printing we cannot refund or credit you for your order.
5.7 If we find at any point during production that we need to make changes to the method of print, we will contact you immediately to confirm these changes and any change in cost. You have the choice to cancel the order or continue accordingly.
5.8 Garment Procurement & Ownership
Once garments, materials, products, or services have been ordered, allocated, customised, prepared, or otherwise committed to an order, they shall be considered committed specifically to that order and may not be cancelled, returned, or refunded.
This applies regardless of whether production has commenced.
5.9 Samples, Blank Garments & Special Order Items
Garments ordered and delivered directly to the purchaser without decoration are non-returnable. This includes sample garments, specially ordered products, approval samples, non-stock items, and custom sourced garments unless found to be faulty.
Where garments or products have been specifically ordered for a customer, 3rd Rail also reserves the right to charge for these items in full once ordered from the supplier, regardless of whether production has commenced.
5.10 Order Reduction / Partial Cancellation
If an order is reduced, amended, postponed, or partially cancelled after confirmation, 3rd Rail reserves the right to:
- Recalculate pricing based on the revised quantities;
• Charge for any garments, materials, labour, setup work, or services already committed to the original order quantity; and/or
• Apply reasonable administrative or handling charges associated with the amendment.
5.11 Recovery of Committed Costs
In the event of cancellation, reduction, postponement, or amendment of an order, 3rd Rail reserves the right to recover all reasonable costs incurred up to that point, including but not limited to:
- Garments and materials;
• Supplier charges and shipping costs;
• Artwork, setup, screen preparation, digitising, sampling, and preparation work;
• Administrative, studio, production, communication and handling time;
• Courier and logistics costs; and
• Any third-party costs incurred on behalf of the customer.
5.12 No Obligation to Refund
Cancellation, postponement, amendment, or reduction of an order does not automatically entitle the customer to a refund, credit, or cancellation of charges.
Any refund, partial refund, or credit issued shall be entirely at the discretion of 3rd Rail and will take into account all costs, commitments, and work already incurred.
5.13 Storage of Cancelled or Uncollected Goods
Where goods, garments, materials, or completed orders remain uncollected, cancelled, abandoned, or delayed due to customer action or inaction, 3rd Rail reserves the right to charge reasonable storage and handling fees.
Where no arrangement has been agreed within a reasonable period, 3rd Rail reserves the right to dispose of, recycle, or otherwise deal with the goods at its discretion without liability.
- SOCIAL MEDIA
6.1 We reserve the right to promote the brands we work with and the services we provide through various social platforms and our website. If you would rather we did not link back to brand/company or would prefer for photos/videos to be released after a certain date please let your sales representative know prior to the start of the production process.
6.2 Marketing, Portfolio & Promotional Usage
Unless otherwise agreed in writing prior to production, 3rd Rail reserves the right to photograph, film, reproduce, publish, and use completed work, including garments, printed products, branding, artwork, production processes, and related materials for portfolio, marketing, promotional, editorial, advertising, social media, website, SEO, case study, trade, and content purposes.
This may include the use of the customer’s brand name, logo, artwork, garments, and associated visual materials.
If a customer requires confidentiality, embargo periods, launch restrictions, or limitations regarding marketing usage, these must be agreed in writing prior to quoting, as the costs the company charges is impacted by it’s ability to promote it’s services.
3rd Rail agrees to act reasonably and respectfully when using customer content for promotional purposes and will not knowingly disclose confidential commercial information.
- Delivery
7.1 As standard our couriers provide £100 of insurance per consignment. If you require additional cover please let us know and we will be happy to arrange a quote.
7.2 Delivery & Transfer of Risk
Risk in the goods passes to the customer upon delivery to the delivery address provided, including where goods are signed for by a third party at that address.
Once delivery has been completed by the courier, 3rd Rail cannot accept responsibility for loss, theft, damage, or delays occurring thereafter.
Any delivery issues must be reported to us within 48 hours of the recorded delivery time.
7.3 Additional Shipping Insurance
Standard courier insurance cover may be limited. Additional insurance cover can be arranged upon request and may incur additional charges.
Where additional insurance has not been requested, compensation for loss or damage shall be limited to the level of cover provided by the courier service used.
- REFERRAL FREE DELIVERY OFFER
8.1 Free shipping only applies to standard UK deliveries
8.2 This offer cannot be used in conjunction with any other offer.
8.3 The offer is valid for 6 months from receiving the offer email.
8.4 Referral rewards are non transferable, non negotiable and has no cash value.
8.5 3rd Rail may amend these terms and conditions from time to time and revised terms and conditions shall become effective immediately upon publishing.
8.6 3rd Rail reserves the right to amend, suspend or cancel the referral program at any time.
- OTHER DISCOUNT AND COUPON CODES
9.1 Coupon value – Coupons are only redeemable for the value specified and within the following terms.
9.2 Eligibility criteria – The coupon is exclusively for customers who are signed up for our newsletter.
9.3 Time limits – The coupon is valid for 28 days from the anniversary date of the initial discount coupon email, unless otherwise stated. At time this may be different or between two specific dates.
9.4 Spending Limits – Unless otherwise stated the maximum invoice total coupons can be applied it is £1000.
9.5 Product / Service Exclusion Rules – Discounts are only applicable to garment printing services mentioned and is not redeemable against other 3rd Rail services such as Live Printing, 3rd Rail Print Space or Print Social products and services unless otherwise stated.
9.6 Exclusion rules – The coupon cannot be used on sale items / clearance merchandise. It is not transferable and not redeemable for cash, credit, or toward previous purchases. It can also not be redeemed against pricing that is already reduced below our standard price lists.
9.7 Usage restrictions – The coupon is valid only when on orders where payment is made up front.
9.8 Coupon stacking – Not valid with any other promotional offers.
9.9 Redemption limits – Coupons can be redeemed only once per customer.
9.10 Applicability to gift cards – The coupon cannot be applied to gift cards or gift card purchases.
9.11 Shipping, taxes and handling charges – The coupon discount does not apply to any additional charges such as shipping, taxes and handling charges.
9.12 Returns policy – Returns or exchanges of items purchased with the coupon will be refunded, if eligible, at the discounted price. Please see our returns policy.
9.13 Fraud prevention – Any attempt to manipulate, reproduce, or tamper with coupons will be considered fraudulent and may result in legal action.
9.14 Modification and termination – The company reserves the right to modify or cancel the coupon at any time without prior notice.
9.15 Dispute resolution – Any legal actions or proceedings arising from the coupon or its usage shall be exclusively brought in the courts of the United Kingdom.
9.16 Print Order Definition – Print order refers to our garment printing service and is not applicable for other services such as Embroidery or Live Print.
10. PROOFING, MOCKUPS & APPROVALS
10.1 It is the customer’s responsibility to carefully review and approve all artwork, specifications, mockups, proofs, dimensions, garment details, quantities, spelling, positioning, colours, and production information prior to confirming production.
10.2 Approval of artwork, mockups, proofs, specifications, or production details by email, message, written confirmation, purchase order, or any other form of communication shall constitute acceptance of those details as correct and approved for production.
10.3 Once approval has been provided, 3rd Rail shall not be responsible for any errors, omissions, spelling mistakes, positioning issues, sizing discrepancies, specification misunderstandings, or other issues contained within the approved materials, including where such errors originated from information, mockups, artwork, or specifications prepared by 3rd Rai, regardless of what has been said previously on email, on a call or anywhere else in the order process. These documents are to confirm 3rd Rail’s understanding of the customer’s order is correct and it is the customers responsibility to check and make sure they are correct before confirming.
10.4 Approval provided by the customer confirms that the customer accepts the final production specification and waives the right to claim for refund, reprint, replacement, compensation, or liability in relation to any approved elements.
10.5 Mockups, digital previews, and visual representations are intended as guides only and may not represent exact scale, positioning, colour appearance, print size, embroidery coverage, garment shade, or finished production outcome.
11. PRODUCTION VARIANCES & TOLERANCES
11.1 Due to the nature of garment decoration, manufacturing processes and also how colours
viewed on backlit monitors differ from real word examples, reasonable variations may occur between mockups, samples, previous orders, digital previews, and final production items.
11.2 Variations may include, but are not limited to:
- Decoration size, positioning and alignment;
• Ink colour and appearance;
• Embroidery sizing, density, and coverage;
• Garment shade, sizing, weight, finish, and manufacture;
• Print texture and feel;
• Shrinkage or wash response; and
• Supplier manufacturing tolerances.
11.3 Minor variations shall not be considered defects and shall not constitute grounds for refund, replacement, compensation, or rejection of goods.
12. INTELLECTUAL PROPERTY & CUSTOMER WARRANTIES
12.1 The customer warrants that they own, control, or otherwise have all necessary rights, permissions, licences, and authority to use any artwork, logos, trademarks, designs, names, or other materials supplied to 3rd Rail.
12.2 The customer agrees to indemnify and hold harmless 3rd Rail against any claims, damages, liabilities, losses, costs, or legal expenses arising from the use of artwork, trademarks, logos, or materials supplied by the customer.
13. FORCE MAJEURE
13.1 3rd Rail shall not be liable for any delay, failure, loss, damage, or inability to perform obligations resulting from circumstances beyond its reasonable control.
13.2 Such circumstances may include, but are not limited to:
- Supplier shortages or delays;
• Courier or logistics failures;
• Machinery breakdowns;
• Utility outages;
• Industrial disputes or strikes;
• Import or customs delays;
• Fire, flood, extreme weather, or natural events;
• Government restrictions; and
• Events affecting third-party suppliers or contractors.
13.3 In such circumstances, lead times and delivery dates may be extended without liability.
14. LIMITATION OF LIABILITY
14.1 To the maximum extent permitted by law, 3rd Rail shall not be liable for any indirect, incidental, special, consequential, or economic loss arising from any order, service, delay, defect, or issue relating to goods or services supplied.
14.2 This includes, but is not limited to:
- Loss of profits;
• Loss of revenue;
• Loss of business opportunity;
• Loss of sales;
• Loss of anticipated savings;
• Damage to brand or reputation;
• Missed launch dates, events, campaigns, or promotions; and
• Third-party costs or liabilities.
14.3 3rd Rail’s total liability in relation to any claim, order, product, or service shall be strictly limited to the amount paid by the customer to 3rd Rail for the specific goods or services giving rise to the claim.
14.4 Nothing within these terms shall exclude liability where such exclusion is prohibited by applicable law.
